Terms of Use

1. What TinyClaw Is (and Isn't)

TinyClaw is a no-code platform for creating, deploying, and tokenizing AI agents on the Base blockchain using Clanker v4 and OpenClaw.

TinyClaw is NOT:

• A broker, dealer, exchange, or custodian
• A financial advisor or investment platform
• A token issuer — tokens are deployed by users via their own wallet signatures
• Responsible for AI-generated content, token values, or trading outcomes

2. Eligibility

You must be at least 18 years old and not subject to any sanctions (OFAC, EU, UN). You are responsible for complying with all applicable laws in your jurisdiction regarding cryptocurrency, blockchain, and AI-generated content.

3. Wallet & Authentication

We use Sign-In with Ethereum (SIWE). Your wallet is your identity. We never have access to your private keys or seed phrases. If you lose wallet access, we cannot recover your account, agents, tokens, or rewards.

4. Your Responsibilities

You are solely responsible for:

• Your AI agents: their configuration, system prompts, behavior, and all outputs across all channels (Telegram, Discord, Slack, WhatsApp, Web)
• Your API keys: we encrypt them (AES-256-GCM) but any charges from LLM providers are yours
• Your tokens: name, symbol, branding, regulatory compliance, and tax obligations
• Complying with third-party platform terms where your agents operate

4.1. API Key Storage & Security

1. Encryption: API keys are encrypted using AES-256-GCM before storage.
2. Your Responsibility: You are solely responsible for all charges incurred by your API keys with LLM providers (OpenAI, Anthropic, Google, etc.).
3. Security Breach: In the event of a security breach affecting encrypted API keys, we will notify you within 72 hours. However, we are NOT liable for any charges, damages, or losses resulting from compromised API keys.
4. Retention: API keys are retained only while you use our hosting service. Upon migration to self-hosting or account termination, API keys are deleted within 7 days.
5. No Warranty: We make no guarantees about the security of stored API keys beyond industry-standard encryption practices.

5. Token Economics & Blockchain

• Token deployment is irreversible. Once on-chain, it cannot be recalled or modified.
• Trading fee rewards are generated by the Clanker v4 protocol, not by TinyClaw.
• We make no guarantees about token value, liquidity, volume, or profitability.
• Displayed rewards are estimates and may differ from on-chain amounts.
• No KYC is conducted by TinyClaw. Regulatory compliance is your responsibility.

6. AI Disclaimer

AI agents are powered by third-party LLM providers (OpenAI, Anthropic, Google, etc.). AI outputs may be inaccurate, biased, incomplete, or harmful. TinyClaw has no control over and assumes no liability for any AI-generated content.

6.1. Third-Party Dependencies & Services

TinyClaw integrates with third-party services that we do not control:

1. OpenClaw Framework: We deploy the latest open-source version of OpenClaw. We are not responsible for bugs, vulnerabilities, or changes in the OpenClaw codebase.
2. Tokenization via Bankr.bot: Token creation is processed through Bankr.bot's infrastructure. We act only as an intermediary. All tokenization risks, fees, and outcomes are governed by Bankr.bot's terms. We are not liable for failed tokenizations, incorrect token parameters, or Bankr.bot service disruptions.
3. Infrastructure Providers (Hetzner, etc.): We use third-party hosting providers. We are not liable for their downtime, data loss, security breaches, or service terminations.
4. Community Skills: You may optionally add third-party community skills to your agent. We provide GitHub links for transparency but do NOT audit, verify, or guarantee the safety, legality, or functionality of these skills. You assume all risks associated with third-party skills including malicious code, license violations, or unexpected behavior.

By using TinyClaw, you acknowledge these dependencies and agree that your recourse for issues arising from third-party services lies with those providers, not with TinyClaw.

7. Container Hosting

Each agent runs in an isolated Docker container. We provide hosting on a best-effort basis with no uptime guarantees. We reserve the right to stop, archive, or terminate any container at any time for abuse, excessive resource usage, security threats, or Terms violations.

7.1. Free Hosting Policy & Inactivity

1. Inactivity Threshold: If an agent remains inactive for 7 consecutive days (no user interactions), we reserve the right to stop the container and archive the configuration.
2. Notification: We will send a notification to your connected wallet address 48 hours before archiving an inactive agent.
3. Configuration Retention: Agent configuration files will be retained for 30 days after archiving, allowing you to migrate to self-hosting.
4. No Recovery Guarantee: After 30 days, configuration files may be permanently deleted. We are not responsible for data loss after this period.
5. Migration Assistance: Archived configurations can be exported via the dashboard for self-hosting migration during the retention period.

7.2. Self-Hosting Deployment Script

1. Script Purpose: Our self-hosting deployment script automates the installation of OpenClaw and its dependencies on your server.
2. Transparency: The script is provided via a bash curl command. You can inspect the script before execution.
3. Your Server, Your Risk: You execute this script on YOUR infrastructure at YOUR OWN RISK. We are not responsible for:
   • Any damage to your server, data loss, or service disruptions
   • Conflicts with existing services or configurations
   • Security vulnerabilities in your server environment
   • Costs associated with server resources
4. No System Modifications Guarantee: While the script is designed to perform only necessary installations, we do not guarantee it will not affect other services on your server.
5. Support Limitation: Self-hosted deployments receive limited support. Configuration issues on your infrastructure are your responsibility.

7.3. Service Level & Availability

1. No Uptime Guarantee: Hosting is provided on a "best-effort" basis. We do NOT guarantee any specific uptime percentage (e.g., 99.9%).
2. Scheduled Maintenance: We may perform maintenance with or without advance notice. We will attempt to notify users 48 hours before scheduled maintenance when possible.
3. Unplanned Downtime: We are not liable for service interruptions due to infrastructure failures, DDoS attacks, provider issues, or force majeure.
4. No Compensation: No refunds, credits, or compensation will be provided for downtime, data loss, or service degradation.

For critical applications requiring high availability, we strongly recommend self-hosting.

8. Prohibited Uses

Don't use TinyClaw to:

• Create harmful, illegal, abusive, or CSAM-related content
• Impersonate people or entities without authorization
• Facilitate fraud, phishing, scams, or pump-and-dump schemes
• Launder money or evade sanctions
• Mine crypto, host illegal content, or abuse container resources
• Reverse engineer, scrape, or attack the Platform
• Violate any applicable law

Violations may result in immediate termination and potential legal action.

9. Intellectual Property

The Platform and its code, design, and branding belong to TinyClaw. You retain ownership of your agent configurations and content. AI-generated content ownership is subject to the respective LLM provider's terms.

10. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT ACCURACY OF AI OUTPUTS, MARKET DATA, TOKEN INFORMATION, OR UNINTERRUPTED OPERATION.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TINYCLAW SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

This includes but is not limited to: financial losses from token trading, wallet compromise, AI agent behavior, smart contract failures, or third-party service issues. Our total liability shall not exceed $1 USD.

12. Indemnification

You agree to indemnify and hold harmless TinyClaw and its team from any claims arising from your use of the Platform, your agents, your tokens, or your violation of these Terms or applicable law.

13. Termination

You can stop using the Platform anytime. We can suspend or terminate your access for any reason. On-chain data (tokens, transactions) is immutable and persists regardless of termination.

14. Changes

We may update these Terms at any time. Continued use = acceptance.

15. Force Majeure & Platform Discontinuation

1. Force Majeure: We are not liable for failure to perform due to causes beyond our reasonable control, including but not limited to: natural disasters, war, terrorism, government actions, internet/blockchain network failures, or third-party service outages.
2. Platform Discontinuation: We reserve the right to discontinue TinyClaw at any time. In such event:
   • We will provide 30 days' notice when possible
   • Agent configurations will remain available for export during this period
   • On-chain tokens are permanent and unaffected
   • Hosted containers will be terminated after the notice period
3. No Ongoing Obligations: Upon discontinuation, we have no obligation to maintain infrastructure, data, or services beyond the notice period.
